These fees, imposed without proper justification, create financial burdens and delays for homeowners, hindering much-needed housing development. At a <strong>2% slope<\/strong>, this increases to <strong>225 GPM<\/strong>, and at a <strong>3% slope<\/strong>, it reaches <strong>275 GPM<\/strong>. Regardless of the slope, this <strong>capacity remains unchanged<\/strong> when an ADU connects through the same lateral. The homeowner <strong>already paid for that capacity<\/strong> when the original lateral was installed with the primary dwelling. <strong>No new system capacity is being created, no additional strain is being placed on the sewer main beyond what was already accounted for, and no expansion of infrastructure is occurring.<\/strong><\/p><\/div><\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-976fbce0 alignfull uagb-is-root-container\"><div class=\"uagb-container-inner-blocks-wrap\">\n<div class=\"wp-block-uagb-advanced-heading uagb-block-5288a4d5\"><h2 class=\"uagb-heading-text\">Unfair ADU Fees<\/h2><p class=\"uagb-desc-text\">Homeowners are facing illegal fees. class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-d5e19b1a175a437821ed4934e711f7d0\">Dear Nicholas,<\/p>\n\n\n\n<p>Thank you for your response and for confirming that <strong>a sanitary district has the authority to require a new or separate utility connection between an ADU and the utility, and if they do, then they may impose a capacity or connection charge.<\/strong><\/p>\n\n\n\n<p>I want to take a moment to highlight an important aspect of capacity fees that is often misunderstood in their application to ADUs. <strong>Capacity fees exist to fund the expansion of a sewer system&#8217;s infrastructure when additional capacity is needed.<\/strong> However, <strong>if an ADU connects to the existing lateral line of the primary residence, the capacity of that lateral\u2014and by extension, the sewer system\u2014does not increase.<\/strong><\/p>\n\n\n\n<p>For example, if the original lateral line was designed for <strong>30 gallons per minute (GPM) of flow<\/strong>, that <strong>capacity remains unchanged<\/strong> when an ADU connects <strong>through the same lateral.<\/strong> The homeowner already paid for that capacity when the original lateral was installed with the primary dwelling. <strong>No new system capacity is being created, no additional strain is being placed on the sewer main beyond what was already accounted for, and no expansion of infrastructure is occurring.<\/strong><\/p>\n\n\n\n<p>It is the <strong>utility district\u2019s responsibility<\/strong> to determine whether an ADU\u2019s addition requires more system capacity. <strong>If additional capacity is necessary, then the district must mandate a new direct connection to the sewer main.<\/strong> That <strong>physical connection<\/strong> is what <strong>triggers the justification for a capacity fee<\/strong>, because at that point, the sewer system is actually being expanded.<\/p>\n\n\n\n<p>However, if no direct connection is mandated, <strong>then no new capacity is being added, and no capacity fee is legally or logically justified.<\/strong> Charging a capacity fee under these circumstances is not only <strong>unlawful under Government Code Section 66324(e)<\/strong> but also <strong>an economically predatory practice that misrepresents the nature and purpose of capacity fees.<\/strong><\/p>\n<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-kadence-pane kt-accordion-pane kt-accordion-pane-13 kt-pane2030_687c8f-7d\"><div class=\"kt-accordion-header-wrap\"><button Mandated Direct Connection are Required for Capacity Fees<\/span><\/span><span class=\"kt-blocks-accordion-icon-trigger\"><\/span><\/button><\/div><div class=\"kt-accordion-panel kt-accordion-panel-hidden\"><div class=\"kt-accordion-panel-inner\">\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-a9536e47bde56d0c9f436463c9118717\">A comment has been posted by an ADU team member on case number ADU0005252, submitted on 02\/03\/2025 05:06:23 PM PST<\/p>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-831e77d6624c9c23a9b22bcb5a0270b6\">&#8220;Thank you for your response. The attached technical assistance letter may not reflect our most current understanding of ADU, which has changed significantly since Greg wrote the letter. For example, Gov Code section 65852.2 no longer exists; these sections have been re-chaptered due to SB 477.&nbsp; Additionally, Greg is no longer on the ADU team.&nbsp;&#8220;<\/p>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-d28b621630551f897abc478b5fbe222f\"><em><u><strong>&#8220;A sewer district must mandate a direct connection before imposing a capacity fee on an ADU.&#8221;<\/strong><\/u><\/em><\/p>\n\n\n\n<p class=\"has-ast-global-color-7-color has-text-color has-link-color wp-elements-7afc7039a731b39e97b3f400d7087b40\">This is true. However, whether local agencies can require a new connection, and accompanying fee, depends on the nature of the ADU at hand.
